# Mediator
Mediators resolve disputes between two parties by examining the case, interviewing both parties, and advising on a solution which would be the most beneficial for them. They listen to both parties in order to facilitate communication and find a fair agreement and organise meetings. They aim at resolving disputes through dialogue and alternative solution without having to take the case to litigation and courts. Mediators ensure that the resolution is compliant with legal regulations and is also enforced.

Aufgaben und TätigkeitenMediatoren und Mediatorinnen tragen dazu bei, Streitigkeiten auf freiwilliger Basis ohne Gerichtsverfahren beizulegen. Sie sind als neutrale Vermittelnde nicht am Konflikt beteiligt, vertreten die Interessen aller Beteiligten und haben das Ziel, Konflikte sowohl auf der sachlichen und als auch auf der persönlichen Ebene beizulegen. Dabei helfen sie den Konfliktparteien, Ziele festzulegen, ins Gespräch zu kommen und gemeinsam eine für alle vorteilhafte Lösung zu finden. Sie studieren die Akten, wägen die Umstände ab und geben den Beteiligten die Möglichkeit, ihre jeweilige Sicht der Sachlage darzustellen. Schließlich strukturieren und begleiten sie die Verhandlungen und erarbeiten gemeinsam mit den Beteiligten eine Lösung, die am Ende in einer rechtlich bindenden Vereinbarung niedergelegt werden kann. Mögliche Einsatzbereiche sind z.B. die Familien-, Wirtschafts-, Umwelt- oder auch Nachbarschaftsmediation.

## Die Weiterbildung im Überblick
Zertifizierter Mediator bzw. Zertifizierte Mediatorin ist eine berufliche Gesamter Bereich der beruflichen Weiterbildung (Anpassungs- und Aufstiegsweiterbildungen); schließt auch die im Berufsbildungsgesetz bzw. der Handwerksordnung als "Fortbildung" bezeichneten Aufstiegsfortbildungen ein

## Entwicklung der Weiterbildung
2017:Inkrafttreten der Verordnung über die Aus- und Fortbildung zum/zur zertifizierten Mediator/in
2020:Novellierung des Berufsbildungsgesetzes (BBiG) und der Handwerksordnung (HWO): u.a. Einführung der Weiterbildungsabschlüsse "Geprüfte/r Berufsspezialist/in", "Bachelor Professional" und "Master Professional", um die Gleichwertigkeit von beruflicher und akademischer Bildung zu betonen. Das Führen der Berufsbezeichnungen ist abhängig vom Erlass entsprechender neuer Fortbildungsregelungen.

## Description (ESCO)
Mediators resolve disputes between two parties by examining the case, interviewing both parties, and advising on a solution which would be the most beneficial for them. They listen to both parties in order to facilitate communication and find a fair agreement and organise meetings.
